How Do Wrongful Death Lawsuits Work?
Many times, people come to me in the absolute worst time of their lives. After their loved one or family member, has passed away due to the result of somebody else’s conduct. In this video I will be discussing wrongful death claims in Kansas and Missouri. The first step in a wrongful death claim is to determine who is the appropriate heir or heirs to pursue the claim. In Kansas, it is determined by statute 60-1902. In Missouri, the appropriate heirs are determined by Missouri statute 537.080. Whether the decedent is married, has children, those are the types of things that will determine who will be an appropriate heir to pursue a wrongful death claim. After determining the appropriate party to pursue the claim, you want to look into an investigation to determine all potentially responsible parties. In a medical malpractice, there may be many different health care providers that were involved, and an investigation and analysis will need to be done to determine who was involved and who was at fault. In a construction site accident, there may be many different contractors or subcontractors and you will need to look at the involvement of each in the incident. In a truck wreck, you need to look at the trucking company, the trucking driver, there are many different levels of leases involved in many trucking claims. So, an investigation to determine all potentially responsible parties needs to be done soon. Finally, the damages that are allowed in a wrongful death case. The damages in Kansas are determined by Kansas statute 60-1904. In Missouri, the statute is 537.090.
